Terms of Service

1. Acceptance of Terms

By accessing or using the Klynx AI website, Dragon governance platform, APIs, SDK, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Klynx AI provides the Dragon AI governance platform, which includes:

• Real-time risk analysis and scoring for AI-driven decisions
• Policy enforcement and approval workflows
• Incident management and OTel-based observability ingestion
• DevOps governance including CI/CD event processing
• The Dragon Playground for interactive demonstration
• Python SDK and REST APIs for programmatic integration

3. Account & API Access

Certain features of the Service require API tokens or authentication credentials. You are responsible for:

• Maintaining the confidentiality of your API tokens and credentials
• All activities that occur under your account or using your tokens
• Notifying us immediately of any unauthorized use of your credentials
• Ensuring your use complies with any rate limits or usage quotas

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service or its infrastructure
• Interfere with or disrupt the Service or the servers/networks connected to it
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit malicious code, spam, or harmful content
• Resell, sublicense, or redistribute the Service without written consent
• Exceed published API rate limits or attempt to circumvent usage restrictions

5. Data Ownership & Governance

You retain ownership of all data you submit to the Dragon platform, including alerts, decisions, policies, and audit records. Klynx AI processes this data solely to provide the Service and does not claim ownership of your content.

Decision outcomes, risk scores, and policy evaluations generated by the platform are derived from your input data and configuration. You are responsible for verifying governance outcomes before acting on them in production environments.

6. Dragon Playground

The Dragon Playground is a demonstration environment. All submissions are tagged as demo data and are not linked to production governance workflows. Playground data may be aggregated for statistical purposes (e.g., total decisions analyzed) but is never attributed to individual users.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide reasonable notice)
• Emergency security patches or critical updates
• Circumstances beyond our reasonable control (force majeure)

8. Intellectual Property

The Service, including all software, algorithms, UI designs, documentation, and branding, is the intellectual property of Klynx AI and is protected by applicable copyright, trademark, and other intellectual property laws.

The Python SDK (klynx-dragon) is distributed under the MIT License. This license applies only to the SDK client code and does not extend to the server-side platform or proprietary algorithms.

9. Limitation of Liability

To the maximum extent permitted by law, Klynx AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Damages arising from decisions made based on platform outputs
• Service interruptions or data loss
• Unauthorized access resulting from compromised credentials

The Dragon platform provides governance recommendations and risk assessments. Final decision-making authority and responsibility remain with the human operators and organizations using the Service.

10. Indemnification

You agree to indemnify and hold harmless Klynx AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or engage in conduct that we reasonably believe is harmful to the Service, other users, or Klynx AI. Upon termination:

• Your API tokens will be revoked
• You may request export of your data within 30 days
• Provisions regarding liability, indemnification, and intellectual property survive termination

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the website. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Klynx AI operates, without regard to conflict of law principles.
